These Terms govern your use of NearUs at alwaysnearus.app and the related service operated by PLAY GAMES LTD (company number 15447714). By creating an account, using the service or buying a web subscription, you agree to these Terms, our Privacy Policy, Billing Terms, and Refund and Cancellation Policy.

1. What NearUs does

NearUs helps family members and trusted contacts voluntarily share location, create places and alerts, manage connections, and communicate. A phone number alone does not reveal a person's location. Location becomes available only when that participant uses NearUs, approves the relevant connection and grants location permission on their own device. Participants can stop sharing, revoke device permission or remove a connection.

NearUs is not an emergency service and does not guarantee continuous, exact or real-time location. Device settings, signal, battery, network availability and operating-system restrictions may affect updates. Contact local emergency services in an emergency.

2. Eligibility and consent

You must be at least 18 to purchase a web subscription. Any use involving a child must be managed by a parent or person with legal parental responsibility and must comply with applicable law. You are responsible for obtaining and maintaining the clear, informed permission of every person whose information or location you access.

3. Prohibited use

You must not use NearUs for covert monitoring, stalking, harassment, coercive control, domestic abuse, employee surveillance, unlawful investigation, or any purpose without the other person's knowledge and permission. You must not bypass consent or security controls, access another account without authorisation, introduce malicious code, scrape the service, resell access, or use NearUs unlawfully. We may suspend or terminate access where we reasonably suspect misuse.

4. Accounts and service availability

Keep account and access details secure and provide accurate information. Features may change as the service develops. We aim to keep NearUs available but do not promise uninterrupted or error-free operation. To the extent permitted by law, the service is provided without warranties beyond those that cannot legally be excluded.

5. Subscriptions

Web subscriptions renew automatically at the price and interval shown at checkout until cancelled. The introductory charge and subsequent renewal terms are displayed before payment. Deleting the app or stopping use does not cancel a subscription. See our Billing Terms and Refund and Cancellation Policy.

6. Intellectual property and liability

NearUs and its original software, branding and content are owned by or licensed to PLAY GAMES LTD. You receive a limited, personal, revocable right to use the service. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence. Subject to those rights, we are not liable for indirect or consequential loss or for loss caused by misuse, third-party services, device settings or events outside our reasonable control.

7. Ending use, changes and law

You may stop using NearUs at any time, subject to separately cancelling any active subscription. We may update these Terms and will publish the effective date here. These Terms are governed by the laws of England and Wales, while preserving any mandatory consumer rights and forum rights that apply where you live.
